New Jersey Juvenile Court Attorneys
If your child is facing charges in Juvenile Court, DYFS can step in and take over the entire case. The case could quickly shift from your child's criminal charges to whether or not the child should be returned home to you for something you did! In other words, you may be blamed for your child's actions. You may have to go on trial to prove that you can parent your child properly! It sounds crazy but as a New Jersey DYFS attorney, I've seen it! In addition, the law authorizes it.
N.J.S.A. 2A:4A-43 of the Code of Juvenile Justice, specifically authorizes the court to "[t]ransfer custody of the juvenile to any relative or other person determined by the
court to be qualified to care for the juvenile[.]" Furthermore, "a court's disposition of a juvenile matter is meant to protect the juvenile," and this may be accomplished by separating
the juvenile from his or her family environment when necessary for the juvenile's health, safety, or welfare. In re S.T., supra, 273 N.J. Super. at
